Welcome to the Bez Tabu Estetic store. The terms “we”, “us” and “our” refer to Bez Tabu Estetic. Bez Tabu Estetic operates this online store and website, including all related information, content, features, tools, products and services, to provide you with a tailored shopping experience (the “Services”). Bez Tabu Estetic is powered by Shopify, which enables us to provide the Services to you.

These terms, together with the policies referenced herein (the “Terms of Service” or “Terms”), set out your rights and obligations when using the Services.

SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are of legal age in your state, country, or region of residence, and you consent to any minor dependents using the Services on devices you own, manage, or purchase.

To use the Services, including browsing our online store or purchasing any products or services we offer, we may ask you to provide certain information such as your email address and billing and payment details. You represent and warrant that any information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS (DIGITAL CONTENT)
The products offered in our store are digital products delivered as PDF files (eBooks). Product descriptions, scope, and content information are provided on the relevant product pages within our Services.

The PDF files may include technical restrictions that limit copying and editing. No password is required to open and read the file; however, depending on the device and software used, certain functions (e.g., copying/editing) may be limited or unavailable.

All product descriptions may be changed at any time without notice at our sole discretion, provided that orders are fulfilled based on the product description applicable at the time of purchase.

SECTION 3 — ORDERS
When you place an order, you make an offer to purchase. Bez Tabu Estetic reserves the right to accept or reject your order for any reason at its sole discretion. Your order will not be accepted until Bez Tabu Estetic confirms acceptance. Before accepting an order, we must receive and process your payment. Please review your order carefully before submitting it, as Bez Tabu Estetic may not be able to accommodate cancellation requests after the order has been accepted. If an order is rejected, changed, or cancelled, we will notify you using the email address, billing address, and/or phone number provided at the time of order.

Your purchases are subject to returns or exchanges only in accordance with our Refund Policy [LINK].

You represent and warrant that you are purchasing for personal use only and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service is the price in effect at the time the order is placed and will be provided in your order confirmation email. Prices include VAT where applicable.

Prices displayed in our online store may differ from prices offered in physical stores, online elsewhere, or through third-party sellers. From time to time, we may offer promotions that may affect pricing and that are subject to terms separate from these Terms. In the event of any conflict between promotion terms and these Terms, the promotion terms will prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our Services. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, accurate, and complete; (ii) you are duly authorized to use the selected payment method for purchases; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges incurred at the prices in effect for your purchases.

SECTION 5 — DELIVERY OF DIGITAL CONTENT
After successful payment, the purchased digital content will be made available to the Buyer automatically, in particular via a download link displayed after purchase and/or sent to the email address provided during checkout.

We provide access to download the digital content for a period of at least 12 months from the date of purchase. We reserve the right to change the method of making the digital content available (e.g., due to changes in store technology, provider, or distribution method); however, we will make reasonable efforts to ensure that the Buyer can download the product within this period, and in the event of technical issues we will provide support as described in the section on complaints and contact.

The Buyer is responsible for downloading and saving the file on their own device or storage media to retain future access.

SECTION 6 — WITHDRAWAL AND REFUNDS
The products offered in the store constitute digital content not supplied on a tangible medium and are made available to the Buyer automatically after payment.

By placing an order, the Buyer consents to the commencement of performance (delivery of digital content) before the expiry of 14 days from the conclusion of the contract and acknowledges that, once delivery of the digital content has commenced, the Buyer loses the right to withdraw from the contract within the statutory withdrawal period, in accordance with applicable consumer protection laws.

SECTION 7 — INTELLECTUAL PROPERTY
Our Services, including but not limited to any trademarks, brands, text, displays, images, graphics, product reviews, video and audio materials, and their design, selection, and arrangement, are the property of Bez Tabu Estetic, its affiliates, or licensors, and are protected by applicable law, including copyright and intellectual property laws.

These Terms permit you to use the Services for personal and non-commercial purposes only. You must not copy, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent. The Bez Tabu Estetic name, logos, product and service names, designs, slogans, and related marks are trademarks of Bez Tabu Estetic or its affiliates/licensors. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

Purchase of an eBook grants the Buyer the right to use the content for personal use only, within the scope of permitted private use. Sharing the file with third parties, distributing it, reselling it, publishing it, or placing it on the market in whole or in part without the prior written consent of Bez Tabu Estetic is strictly prohibited.

SECTION 8 — OPTIONAL TOOLS
We may provide you with access to third-party tools as part of the Services that we neither monitor nor have any control over.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, conditions, or endorsements. We shall have no liability arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the website is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third party.

We may also, in the future, offer new features through the Services (including new tools and resources). Such new features shall also be considered part of the Services and will be subject to these Terms of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third-party features). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you access. If you choose to leave our Services to access third-party materials or websites, you do so at your own risk.

We are not liable for any harm or damages related to your access to third-party websites or your purchase or use of any products, services, resources, or content from third-party websites. Please review third-party policies and practices carefully before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the relevant third party.

SECTION 10 — RELATIONSHIP WITH SHOPIFY
Bez Tabu Estetic is powered by Shopify. This enables us to provide our Services to you. However, any sales and purchases made in our store are made directly with Bez Tabu Estetic. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Bez Tabu Estetic, including any injuries, damages, or losses resulting from the purchase of products or services. You expressly release Shopify and its affiliates from any claims, damages, and liabilities arising from your purchases and transactions made in the Bez Tabu Estetic store or related thereto.

SECTION 11 — PRIVACY POLICY
Any personal data we collect through the Services is subject to our Privacy Policy, which can be accessed here [LINK], and certain personal data may also be subject to Shopify’s Privacy Policy, which can be accessed here. By using the Services, you acknowledge that you have read these policies.

Information submitted through the Services will be transmitted to and shared with Shopify and with third parties that may be located in countries other than your country of residence in order to provide services to you. We are under no obligation (1) to maintain any Feedback in confidence; (2) to pay compensation for any Feedback; or (3) to respond to any Feedback.

We may, but have no obligation to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, otherwise objectionable, or that violates any party’s intellectual property rights or these Terms.

You acknowledge that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary rights. You further acknowledge that your Feedback will not contain unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You must not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you provide and its accuracy. We assume no liability for any Feedback posted by you or any third party.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

In addition, you agree (a) not to upload or transmit viruses or any other malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services; (c) not to collect or track the personal information of others; (d) not to spam, phish, pharm, pretext, spider, crawl, or scrape; and (e) not to interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet. The following sections shall survive termination: Intellectual Property, Feedback, Termination, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 16 — COMPLAINTS AND LACK OF CONFORMITY OF DIGITAL CONTENT
If you experience issues accessing the digital content, encounter technical errors with the file, or suspect that the digital content is not in conformity with the contract, you may submit a complaint to: shop@beztabuestetic.pl

Your complaint should include at least: your name, the email address used for purchase, the product name, and a description of the issue.

We will review complaints within a reasonable time and take steps to bring the digital content into conformity, in particular by re-delivering the file or providing a working version of the file. If bringing the content into conformity is not possible or would be disproportionately costly, the Buyer may have the right to a price reduction or a refund in accordance with applicable laws.

SECTION 17 — DISCLAIMER
The information provided on or through the Services, including digital products and any accompanying materials, is made available for general informational and educational purposes only. While we make reasonable efforts to ensure that the content is accurate and up to date, we do not guarantee its accuracy, completeness, reliability, or usefulness.

Some content made available through the Services may be created or assisted by automated or artificial intelligence tools. Such content is provided without any guarantees as to its suitability for any specific purpose.

Any reliance you place on the information provided through the Services is strictly at your own risk. To the fullest extent permitted by applicable law, Bez Tabu Estetic disclaims any responsibility or liability for actions taken or not taken based on the content made available through the Services.

This limitation applies regardless of whether we have been advised of the possibility of such damages and regardless of the form of action.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable consumer protection laws.

You agree to indemnify, defend, and hold harmless Bez Tabu Estetic, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

(2) your violation of any applicable law or the rights of a third party; or

We will notify you of any such claim subject to indemnification, provided that failure to notify you promptly will not relieve you of your obligations unless you suffer material prejudice as a result. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with any policies or rules posted by us on the Services or incorporated by reference, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and us.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You may not assign, transfer, or delegate these Terms or any rights or obligations hereunder without our prior written consent, and any attempted assignment without such consent shall be null and void. We may assign, transfer, or delegate these Terms and our rights and obligations at any time without notice or consent.

These Terms of Service and any agreements under which we provide the Services shall be governed by and construed in accordance with the laws of Poland.

Nothing in this section shall deprive consumers of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence, where such provisions apply.

Headings used in these Terms are included for convenience only and shall not limit or otherwise affect the interpretation of these Terms.
